Canadian Work Permit and LMIA:
Almost all Canadian work permits require a Labour Market Impact Assessment (LMIA), formerly called a Labour Market Opinion (LMO), in order hire a temporary foreign worker. A positive LMIA confirms that there is a need for a temporary foreign worker, while a negative LMIA asserts that a Canadian should be employed in the position.
What is a Labour Market Impact Assessment (LMIA)?
An LMIA is a labour market verification process whereby Employment and Social Development Canada (ESDC) assesses an offer of employment to ensure that the employment of a foreign worker will not have a negative impact on the Canadian labour market.
LMIA Based Work Permits:
There are two steps in getting LMIA based work permit: –
- First, the applicant must submit an application to ESDC for a Labour Market Impact Assessment,
- A second application to Citizenship and Immigration Canada (CIC) for the actual work permit.
The LMIA is issued by ESDC who, after considering numerous protective labour market factors, authorizes the Canadian employer to hire a foreign worker.
Time duration to get LMIA:
ESDC has committed to a 10 business day service standard for certain LMIA applications pertaining to high demand jobs and for jobs with a short duration work period (less than 120 days).
Exemptions to LMIA:
- International Mobility Program
The reason for its popularity is the quicker and easier work permit application process. The IMP is designed to cater to Canada’s broader economic and cultural interests through international agreements and youth exchange programs.
In order to hire a foreign worker through the IMP, a Canadian employer must follow three steps:
- Confirm the position or worker in question qualifies for an LMIA-exemption;
- Pay the employer compliance fee of $230 CAD;
- Submit the official job offer through the IMP’s Employer Portal.
- International Agreement
A significant number of LMIA-exemptions are available through international agreements between Canada and other countries.
- North American Free Trade Agreement (NAFTA)
- Canada-Chile FTA / Canada-Peru FTA / Canada-Colombia FTA / Canada-Korea FTA
- Canada-European Union Comprehensive Economic and Trade Agreement (CETA)
- General Agreement on Trade in Services (GATS)
- Intra-Company Transferees:
Through this provision, certain companies may transfer a foreign national to a Canadian location in order to improve the quality of their business for the benefit of Canadians.

Canada Work Permit is applicable for individuals from the following categories:
- Temporary workers – Canada offers Open Work Permits and Employer-specific Work Permits based on the applicant’s qualification and the nature of the work. Temporary workers are also allowed to change or extend their work permit.
